Legal Rights For Mesothelioma Victims
In the 1920s the corporations in New York and the entire US were aware of the ill effects of asbestos on the workers. But, still they remained silent without informing the workers and the society about the harmful effects of asbestos. These Corporations had chosen profit over people. Human rights had been violated. The threat is not over! As per the statistics given by the Environmental Protection Agency, asbestos is found in 7, 33, 000 buildings in the US and in over 3000 products.
Asbestos was banned in the US in the 1970s but its effect can still be felt today because of its long latency period. People are susceptible to Mesothelioma when they are exposed to rough asbestos fibers in industries like steel, oil and gas refineries, construction and building, demolition works, rail roads, ship yards. Even people who are residing in the neighbor hood of former asbestos manufacturing plants are also prone to Mesothelioma.
Although monetary compensation from the ones who are responsible for such a disaster is not enough to alleviate the pain caused to the affected persons or to their loved ones, but this can compensate for the monetary losses due to high costs of treatment, loss of income due to the death of an earning member and also to continue support for the family members of the affected or the deceased person.
It is known that one cannot claim compensation without opting for a legal enforcement. Two types of Mesothelioma lawsuits are in practice. One of them is the personal injury claim and the other one is a wrongful death lawsuit. In the former one the Mesothelioma patient files the suit to claim compensation for the damages caused to him and in the latter one, a family member of the deceased person files the suit. The process takes time and so it would be wise to take actions without much delay. After all, justice delayed is justice denied!
