Claim Justice!

It is a known fact that nothing can be achieved on this Earth by begging. It is by force that anything can be achieved. And what, if this force is backed by the law of the state? In other words, legal enforcements allow an individual to exercise his legal rights. Mesothelioma is a cancer that was preventable if the Corporations in the US took proper precautions by informing the workers about the harmful effects of asbestos exposure. This tragedy has called for two types of Mesothelioma Law suits. These are personal injury claim, which is filed by the patient himself and the lawsuit for wrongful death, which is filed by the survivor of a Mesothelioma fatality.

Each type of claim consists of different laws and procedures and one's legal right to claim compensation is dependent on a number of factors. As per the "statute of limitations," there is time limit for filing a claim and it starts from the date of diagnosis of Mesothelioma. If an affected person does not file a suit within the prescribed period, he would lose his right to claim damages.

Sine the disease has a long latency period, so the time frame between asbestos exposure and diagnosis might be as high as 50 years but this does not mean that one would lose the right to file a suit because of this long period of gap. However, the "statute of limitations" might play a role in an individual's right to claim for damages.

It is advised to have a consultation with an experienced attorney who would help to prove that a particular manufacturer had exposed the patient to asbestos for a particular period. Important cause- effect information needs to be presented in a justified and logical manner with a proper consultation with an expert.

Time has now come to stand straight against the disease in terms of not only awareness, diagnosis and treatment but also the right to challenge the causes behind an ill- fate.
